COMMUNITY PROPERTY JOINT TENANCY  INFORMATION

In Texas, to create a valid joint tenancy with right of survivorship in community property, an agreement signed by both spouses is required.  It is not sufficient to to simply state in the deed that the property is to held in joint tenancy with survivorship rights.  This document should be used as part of a comprehensive estate plan.  It will pass title to property described in the agreement to the survivor.
